User Agreement for SPA StarLine LLC

1.1 This user agreement (hereinafter - Agreement) defines the terms and conditions of use of the SPA StarLine LLC services (hereinafter - StarLine) for the Internet user (hereinafter - User). Starting to use any service or its separate functions or having passed registration procedure, User unconditionally accepts terms of the Agreement in full and in accordance with article №438 of the Civil Code of the Russian Federation. In case of disagreement User with any of provisions of this Agreement, User may not use StarLine services.

1.2. StarLine provides Users access to the services, including navigation, communications, shopping, search, control, vehicles' control, etc. Subject of this Agreement are all existing at the moment StarLine services, any their development or new services.

1.3. Terms and conditions of use of StarLine services is governed by this Agreement, the Privacy Policy (https://my.starline.ru/privacy-policy/en.html), as well as conditions of use of certain services if there are any. This User Agreement is a public document. Agreement may be amended StarLine unilaterally without any special notice. The new edition of the Agreement enters into force upon its publication in Internet specified in this paragraph address, unless otherwise provided in the new version of the Agreement. If StarLine made any changes to the Agreement from which the User does not agree, he must stop using StarLine services.

2.1. A unique User account in the StarLine system is created in order to allow the User to use StarLine services or some individual features of the services. User registration in the system is free and voluntary.

2.2. In the interests of security, when registering an account the User must provide reliable information on all items required in the registration form and marked with a special symbol (*), and to keep this information up to date.

2.3. StarLine undertakes to store and to process all personal information of the User contained in the account, in accordance with the privacy Policy (https://my.starline.ru/privacy-policy/en.html).

2.4. In the case of pre-registration of the User's device at the StarLine production, User receives a registration card with a unique character account name (username) and a generated password to access it. In the future, User may change the password to account from personal profile of the StarLine services, and use registered email address as a login.

2.5. Upon registration new account at the StarLine services User chooses himself username (unique symbolic name of a User account) and password to access account. For security purposes, StarLine has the right to prohibit the use of certain logins and impose other requirements on the login and password (length, permissible symbols, etc.).

2.6. User is independently responsible for the security of the chosen password and keeping it confidential. Any actions committed using the login and password of the user account are deemed to be performed by the respective User except for cases when User promptly notify StarLine of any unauthorized access to his account.

2.7. User is obliged to notify of any unauthorized access to the StarLine services with the use of his account or any violation of the confidentiality of his password.

2.8. For security, User must independently completion of the sessions using StarLine services with "Exit" button or menu item "Exit". StarLine is not responsible for lost of the user data, as well as other consequences of any nature that may occur due to violation of the provisions of this Agreement.

2.9. StarLine has the right to block or delete user's account, prohibit access to certain StarLine services and delete any content without giving reasons including in case of violation of the terms of Agreement or conditions of other documents provided for in paragraph 1.3.

3.1. StarLine has the right to restrict the use of the services, including: lack of separate functions of services, the shelf life of the events' history and routes of the User, the maximum number of geofences and geotagging, which can be used by one registered User, the maximum number of configurable event notifications, the maximum number of service requests for a specified period of time, etc. StarLine can forbid the automatic recourse to the services and to stop accepting any information generated automatically.

3.2. StarLine does not guarantee compatibility and function properly of its Services on the devices from other manufacturers if their hardware or software platform is older than two years. The constraint applies to all computer and mobile electronics, including mobile phones, computers, laptops, tablets and smart watches. StarLine recommends its Users to keep current versions of operating systems on their devices in accordance with the specific requirements of the Services.

3.3. By accepting this User Agreement, User agrees that in order to improve service quality, services development and security, StarLine can send its users informational and promotional messages.

3.4. In aim of enhancing quality and safety of services, User grants the rights to StarLine to transfer the depersonalized information about VIN number, mileage, trouble codes from his vehicle to car dealer centres, where the telematics equipment was installed.

4.1. User personally responsible for their actions related to the use StarLine services, including if such actions lead to violation of rights and legitimate interests of third-party, as well as compliance with legislation.

4.2. Using StarLine services, User may not:

• to post or distribute information containing profanity or obscene language, as well as information that is unlawful, harmful, slanderous, offends public morality, promotes violence and cruelty, violates intellectual property rights, contains insults to any persons or organizations;
• it is illegal to collect and store personal information of others;
• disrupt the normal process of web sites and StarLine services;
• to promote actions aimed at violation of the restrictions and prohibitions imposed by the Agreement;
• otherwise violate applicable laws, including international law.

4.3. Any information used in StarLine services, including maps and information about routes is intended exclusively for personal, noncommercial use.

4.4. StarLine services provide User the ability to add his own user information, including geofence, geotagging, text captions and so on (custom objects). Adding custom objects does not modify the original user data and is used for ease of use of StarLine services.

4.5. User independently accept all risk and liability for the selection of the location, designation and description of the custom objects. The number, shape and location of the custom object can affect the amount and frequency you receive notifications from the StarLine services. StarLine reserves the right, without notice and in its sole discretion to remove any User object if its description is contrary to the legislation of the Russian Federation, contains profanity or is in violation of this Agreement. In connection with the development or modify StarLine services safety of the User objects is not guaranteed.

5.1. All objects and content posted on the StarLine services, are objects of exclusive rights of StarLine, Users and other rights holders.

5.2. Use of any elements of the StarLine services is possible only as the part of the provided services. Copying, processing, distribution, etc. is prohibited without the prior permission of the copyright holders.

6.1. User agrees to use the services provided by StarLine and received through the information at his own risk. User is independently responsible for any consequences of using this information, including damage that this may cause to third-party, for loss of data or any other damage. StarLine assumes no liability for any losses resulting from the use by User of the StarLine services, and disclaims all warranties that the StarLine services correspond to the specific User's goals and requirements.

6.2. StarLine does not guarantee that:

• the services will be uninterrupted, timely, secure or error-free;
• data that can be obtained using the services will be accurate or reliable;
• the quality of any products, services or information obtained from use of the services will meet User expectations.

7.1. This Agreement between StarLine and User regarding the rules and terms of use replaced all prior agreements between StarLine and User.

7.2. This Agreement shall be governed and construed in accordance with the legislation of the Russian Federation. The issues not regulated by this Agreement shall be settled in accordance with the legislation of the Russian Federation.

7.3. In the case of any dispute or disagreement related to the execution of this Agreement, StarLine and User will make every effort to resolve them through negotiations between them. If disputes cannot be resolved by negotiation, the disputes shall be settled in the order established by the current legislation of the Russian Federation.

User confirms that he is informed with all paragraphs of this Agreement and unconditionally accepts them.
